Litigation
Our litigation services span the normal range of legal services in respect of cases before a Court or Tribunal, including evidence gathering, case analysis, drafting, filing and serving Court or Tribunal documentation, appearing and instructing Counsel before the relevant Courts or Tribunals, and all the other typical activities relating to taking, defending, settling or, if circumstances permit, heading off legal/administrative action as the needs of our clients dictate.
However, here at BL, we treat our litigation services as a complement to services we provide under the other Legal Services headings (see left), especially those within our areas of expertise. In practice, this means that, although we may conduct proceedings before Courts or Tribunals in appropriate circumstances, including cross-jurisdictional cases, we do not ‘jump’ or ‘rush’ to litigate. In line with modern best practice, we believe in examining disputes holistically, meaning that we regard Court/Tribunal action as a ‘last resort’ and we take a broad, positive view of litigation as including:
- letters/notices before action (e.g. ‘cease and desist’);
- settlement negotiation and drafting terms of settlement; and
- alternative dispute resolution (ADR), including commercial arbitration and mediation.
