Anti-Counterfeiting
At Buchanan Law, we protect intellectual property in two ways. Firstly, to recognise and appropriately advise our clients on mechanisms for protecting branding through trade mark registration and other like services. Secondly, we have developed capacity and specialisation in anti-counterfeiting.
The BL team is committed to developing anti-counterfeiting programs that suit the individual needs of each client based on business type, product type, branding and budget.
Our anti-counterfeiting strategies hit not only at the border, but also within Australia. There are three main elements of our anti-counterfeiting program:
Prevention
- Drafting and filing Notices of Objection with Customs.
- Registering for the Verified Rights Owner Program (VeRO) on eBay and similar schemes on other online trading sites.
- Market watching services, both online (including domain name searches) and in the marketplace.
Civil Enforcement
- Identification of the counterfeiter.
- Notifying the counterfeiter of the claim to IP rights.
- Drafting letters of demand to the counterfeiter to cease trade and pay damages.
- Coordinating applications to the courts for injunctions.
- Seeking Anton Pillar orders.
- Coordinating Court proceedings to recover damages.
Criminal Enforcement
- Reporting to police & presenting any evidence.
- Private criminal prosecution.
Further to providing these services to our clients, we are committed to policy and legislative reform to better protect both manufacturers and consumers from the potential dangers posed by counterfeiting of ‘mission critical goods’.
